A U.S. federal judge upheld the expulsion of former New York State Senator Hiram Monserrate from the New York State Senate in a ruling on Friday. Monserrate had been found guilty in October of misdemeanor assault, in the criminal trial involving an alleged attack on his girlfriend Karla Giraldo.

Monserrate was expelled from the New York State Senate last week by a majority vote of his fellow senators. The result of the vote was 53 to 8 in favor of expulsion.

Federal judge William H. Pauley III denied a request to temporarily block the expulsion. A lawsuit had been filed by Monserrate, which had asked for a reversal of the former Senator’s explusion and in addition sought a block on a March 16 special election for a replacement.

The New York Civil Liberties Union supported Monserrate in the case. The former Senator argued that the act of being expelled from the Senate was not appropriate, as he claimed it violated due process.

the power of a body to determine the fitness of its members is embedded in American democracy.

Judge Pauley ruled, “the question of who should represent the 13th Senatorial District is one for the voters, not for this court.” The judge explained that the voting rights of the citizens of the district formerly represented by Monserrate would not be significantly negatively impacted, due to the proximity of the upcoming special election. Monserrate has stated that he will run in the special election, and he is not prohibited from doing so.

The court’s ruling determined that the expulsion by the New York State Senate was not inappropriate, stating, “the power of a body to determine the fitness of its members is embedded in American democracy.” Judge Pauley noted, “Similar processes to discipline have long existed in deliberative bodies at all levels of government.”

We are gratified that the Court has confirmed our position that the Senate had the authority to expel Mr. Monserrate.

New York State Attorney General Andrew Cuomo issued a statement in support of the judge’s ruling. “We are gratified that the Court has confirmed our position that the Senate had the authority to expel Mr. Monserrate,” said the Attorney General. According to The New York Times, Monserrate was expected to appeal the ruling of the court.

Monserrate’s misdemeanor assault conviction pertained to an incident where he dragged his girlfriend through the lobby while exiting his apartment building. He was acquitted by a judge of charges of felony assault. Felony conviction would have resulted in an immediate expulsion from the New York State Senate.

Monserrate is the first politician to be expelled from the New York State Senate in almost a century. He is a former New York City police officer. Prior to becoming a member of the New York State Senate, he was a city councilman. He became a member of the New York State Senate weeks after the alleged conflict with Giraldo, and was made chair of the committee overseeing consumer affairs. Along with Democrat Pedro Espada Jr., Monserrate started a shift in control of the Senate by aligning with the Republican Party.

If a person is looking into relocating and considering going across the map the job may seem too large of a task. It doesn’t have to seem impossible though, because with some simple choices moving to France can be made painless and stress free. The first thing a person will want to do is make contact with a quality moving company that can help them make some of the more difficult tasks simpler. If this is unfamiliar territory for someone, here are a couple of pointers to get them started in the right direction.

Decide On A Moving Company

When a person has decided on moving to France it can lighten the burden of decision making if they decide to use a professional moving company. If a person hasn’t already used one in the past, they will be pleasantly delighted with all the different ways a quality service can help ease them into this new transition. Moving to France will become painless the minute a quality moving company is brought on board. This means a company that offers a variety of services, different rate plans, is international, and has been doing this for some time.

Now where might a person find such a company? That’s easy. The first place is to try different online searches. Scroll through all the sites carefully to see what is offered and what may be the best choices to select from. After discovering a few choices, read up on some of their customer reviews to make an informed selection. After this make sure to call some of the companies that really stand out and go over some of the precise details of the particular move with them. This will help them to be able to finalize rate quotes and give an idea of what their booking schedule may look like.

What If Moving To France Means Crossing An Ocean?

Don’t sweat it. When a professional company is helping with the services there’s nothing they won’t be able to do. Getting all those collectibles, or heirlooms passed down from grandma with safely to a new home is just one of the things they’ll be confident at. They will also be able to help a person arrange to have surplus items put into storage for use at a later date, help with packing materials, and offer different advice to get a person through a life changing move.

Having these services within one company can really take a lot of weight off of someone’s shoulders when a big move is just around the corner. Going to a new country for a vacation can end up being stressful, moving to France to stay can be even more so. That’s why having some people on board that can help with every step of the process is the best decision a person making this kind of change can make. Make sure to plan ahead for these needs. It will make the move smoother, and settling into a new home and country all the more fun and enjoyable.

Myrtle Beach, South Carolina —This weekend is the kick-off for two motorcycle rallies held annually in the U.S. eastern seacoast town of Myrtle Beach. Enthusiasts this year are expected to meet or exceed the 170,000 bikers that arrived last year in droves to the small resort town of 23,000. Festivities span two weeks, and extend again this year into the Memorial Day.

Leading off is the week-long Harley rally, followed by the next week’s BikeFest. In and around town, both day and night are punctured by the sounds of bike engines gunned and revved at stop lights and in parking lots. Groups of cycle riders dominate the streets.

“By Friday night, the front parking lot will be a full line of motorcycles to the corner.” said motel owner Ranjan Patel. The Super 8 motel takes up half a block at its location in the heart of the downtown motel strip. “Both sides [of Ocean Blvd] are nothing but bikes.” Both she and her co-owner husband agree, the influx of bikers dwarf in size the numbers of tourists who visit during regular summer months for ocean-side and family amusement park attractions.

The highly accesorised bikes, decked with chrome and polished to show it, flashed the townscape. Choppers made a showing, but road hogs dominated the ridership, often going twosome. Many rally goers arrived on the scene with SUV’s or big pickup trucks towing cargo trailers loaded with cycles.

Growth in the sheer size of the two rallies led police to make changes in the handling of traffic flow. During BikeFest last year, the mostly black crowd that came in on the heels of the largely white Harley rally the week earlier, were faced with confusion when the two-lane Ocean Blvd was made one-way.

A branch of the NAACP in Conway, the next town over from Myrtle Beach, alleged discrimination by Horry County and Myrtle Beach Police. They claimed authorities and police used an overwhelming and aggressive police presence, combined with a restrictive one-way traffic pattern, to intimidate and discourage the participants in the rally.

An injunction was issued earlier this week by U.S. District Judge Terry Wooten, who ruled that bikers at both rallies be treated the same. Myrtle Beach city lawyers immediately filed an appeal to the ruling at the Fourth U.S. Circuit Court of Appeals, saying “the trial court erroneously determined that the plaintiffs would likely succeed on the merits; that is, that the city of Myrtle Beach intentionally treats Memorial Day weekend tourists differently from others similarly situated because of their race.”

A plan to submit an opposition to the notice has already been announced by Michael Navarre, an attorney for Steptoe & Johnson, who represents the NAACP civil rights group. “We certainly don’t think the judge has ruled erroneously,” Navarre said, according to The Sun News.

Traffic control and safety measures were in full swing Friday morning on US-17. Both directions of the 4-lane divided highway south of Myrtle Beach had traffic cones and parking barriers set up to control traffic. Large flashing road signs on each side of the highway warned cars to use the passing lane. The warning sign flashed a message that the right lane was for motorcycle use only. Police monitored the pull-offs near a Harley dealer’s lot where popular attractions were set-up in the immediate vicinity.

Just days away from Halloween, Wikinews interviewed Kristian Hanson, producer-director of independent slasher film Sledge. The film has been a recent source of discussion in horror fan circles, primarily due to its production budget of only US$800. Sledge is Hanson’s fourth film to direct, according to Internet Movie Database.

Former Salt Lake City mayor and human rights activist Rocky Anderson took some time to discuss his 2012 U.S. presidential campaign and the newly-created Justice Party with Wikinews reporter William S. Saturn.

Anderson served as mayor of Salt Lake City for eight years (2000–2008) as a member of the Democratic Party. During his tenure, he enacted proposals to reduce the city’s carbon emissions, reformed its criminal justice system, and positioned it as a leading sanctuary for refugees. After leaving office, Anderson grew critical of the Democratic Party’s failure to push for impeachment against President George W. Bush, and for not reversing policies on torture, taxes, and defense spending. He left the party earlier this year and announced that he would form a Third party.

Anderson officially established the Justice Party last week during a press conference in Washington D.C.. He proclaimed “We the people are powerful enough to end the perverse government-to-the-highest-bidder system sustained by the two dominant parties…We are here today for the sake of justice — social justice, environmental justice and economic justice.” The party promotes campaign finance reform and is attempting to appeal to the Occupy Wall Street movement. It is currently working on ballot access efforts, and will hold a Founding Convention in February 2012 in Salt Lake City.

Among other issues, Anderson discussed climate change, health care, education, and civil liberties. He detailed his successes as mayor of Salt Lake City, stressed the importance of executive experience, and expressed his views on President Barack Obama and some of the Republican Party presidential candidates. He spoke in depth about former Massachusetts governor Mitt Romney, with whom he worked during the 2002 Winter Olympics, and fellow Utahan, former governor and U.S. ambassador to China Jon Huntsman, Jr..

Sunflower Oil: the Natural Skin Care Oil

by

Laura Thomas

Sunflower oil is used for more than just cooking: it is also an excellent product for use as a natural skin care oil that imparts many benefits when rubbed into your skin. For a start, it retains moisture, and in preventing your skin from drying out it helps to keep wrinkles at bay and your skin looking youthful and vibrantly healthy right from birth.

Yes, from birth, because it is used in hospitals on the skin of premature babies to protect it from infections to which young children are susceptible when in hospital, particular those born pre-term. How’s that for an indication of how safe it is to use and how gentle it is on your skin? Yet it is extremely powerful at keeping away bacteria and maintaining youthful skin, and contains a rich mixture of vitamins and other natural substances that have a healthy effect on your skin and its pores.

There is a lot more to sunflower oil than just that however. It is what is referred to as non-comedogenic, meaning that, unlike many other oily substances, it will not cause spots or pimples to form when you rub it into your skin. It is very good for acne sufferers, especially if the traditional acne remedies have failed. It is very high in antioxidants, particularly the antioxidant vitamins A, C and E, which prevent free radicals from damaging your skin and creating wrinkles and the appearance of premature aging.

Nobody likes having tough leathery skin that looks decades older than they really are, but that’s what can happen to people who live in hot climates because of the action of ultra-violet light in strong sunlight on their skin. UV generates small oxygenated molecules known as free radicals that destroy your skin cell membranes. That makes your skin old looking and wrinkled, and even causes these ugly brown liver spots. Sunflower oil destroys these free radicals as soon as they are formed and offers a high degree of protection against sunlight and the other causes of free radical generation such as air pollution, tobacco smoke and pesticides.

Sunflower oil also contains fatty acids that kill off damaging bacteria on your skin, and the Vitamin D it contains supports your immune system to help prevent inflammatory conditions such as acne. In addition to their antioxidant properties, Vitamins C and E promote the growth of healthy new skin, and can rapidly repair and damage any blemishes from which your skin is prone to suffer, particularly during the cold winter months, again helping to keep it looking youthful and fresh.

You can find sunflower oil in the ingredients list of many expensive skin care products, including body washes, lotions and soaps, and although the natural oil itself is just as good as any of these expensive commercial products, it is better to use it in a purified form or along with other natural oils in mixtures designed to complement each other and make the best use of the skin care properties of each.

Last Saturday, the “Intel Taiwan Overclocking Live Test” took place in the Taipei World Trade Center in Taipei, Taiwan, which drew many spectators to come and see the hardware experts at work. Overclocking (running computer hardware at a higher clock rate than normally) is more of an enjoyment for senior gamers or engineers, while the average computer users may lack the basic concepts of it, causing hardware to halt when they attempt it.

With those issues in mind, Wikinews freelance reporter Rico Shen interviewed Peter “Shamino” Tan, an overclocking expert from Singapore, to clear up some of the basic issues relating to overclocking.

Two web sites purporting to sell tickets to the 2008 Summer Olympic Games due to open in Beijing, China on Friday have been the subject of lawsuits from the International Olympic Committee in United States courts in recent weeks. The web sites, beijingticketing.com and beijing-2008tickets.com, were designed to resemble official sites and often appeared above the official sites in Google searches, and scammed some victims out of up to US$50,000 each for tickets to events such as the Opening Ceremony and swimming, which were listed despite the official Beijing ticket web site stating that tickets to all events had sold out as of July 27. The sites are believed to have taken in millions of dollars in total.

Ken Gamble, a private investigator from Sydney, Australia, believes the sites are operated by Terance Shepherd, whom Gamble has been tracking for several years in relation to other fraudulent web sites selling tickets to events such as the FIFA World Cup. According to Gamble, Shepherd’s modus operandi involves setting up the fake web sites, overselling the tickets, and then failing to produce the tickets. “The story’s always the same,” Gamble said, “it’s an ‘unfortunate mistake’ or someone has ‘let them down’. They promise a refund, which never happens, and the credit companies end up paying all the refunds.” Shepherd owns a home in the London suburb of Blackheath, although authorities believe he is currently hiding in Barbados.

On Monday, beijingticketing.com customers received an email from someone named “Alan Scott”, claiming that the site’s ticket supplier had filed for bankruptcy. The email recommended that customers should contact their credit card companies to seek refunds “immediately”, and said that the company would set up a call centre to provide assistance to its customers. However, the site has been shut down and a phone number previously listed on it has been disconnected. The company’s address, in Phoenix, Arizona, was found to be an empty office space. Visa International has stated that victims who used their Visa card to pay should be able to get their money back, but it is not yet clear whether the same will apply to all customers.

In case you may be wondering, the ease and speed of applying for and getting a visa to China could be relative to the documents you have. It could also depend on your purpose of going to the country. As you know, you could easily and quickly get a visa to China if you are a student who has been admitted formally to enroll in a Chinese university. It would also be easier if you have obtained employment in a mainland-based company that has also provided you with an invitation letter to work in China.

Some people may experience difficulty in applying for or getting a visa to China. However, the difficulty could be related to some discrepancies or some bad records that an applicant may have. Particularly, individuals who have records in overstaying in China or in other countries in the past could raise immigration suspicion. It is not yet clear whether tarnished credit or specific criminal records could have a direct impact for any application of visa to China. The application process may also depend on ownership of a passport by the applicant. If he does not own a passport, it is a requirement to secure one first before applying for a visa to China.

Application guarantees

Other than that, it is basically easier and faster to apply for a visa to China. In general, applying from the US could be easy and convenient. It may take about four days or as fast as just a day to secure and get a visa to China. The application could be processed by the Chinese Embassy or Consulate Office anywhere in the US. These days, some applicants find it more convenient to have the visa to China processed and applied for by a reliable and trustworthy travel agency on their behalf.

It could be easier if you have relatives who are currently based in China. If you have family members who are in the mainland, chances are greater that you could more easily apply for and obtain a visa to China if you intend to visit your relatives soon. It would also be easier if you have received invitation letters from any company, school, business, or employer that is based in the country.

Groups and foreign relations

Fortunately, the US and China have a good diplomatic relationship. Thus, residents of the US may not experience difficulty in applying for a visa to China. Residents of other countries with good foreign or diplomatic relationship with China could also experience the ease in applying for a visa to China. It is advisable to constantly check the current relationship of your country to China before you intend to apply for a visa going to the country.

Some travel agencies may reveal that it is much faster, easier, and convenient to apply for a visa to China if you are applying with or as a group. Tourist groups are usually more prioritized when it comes to processing visa applications. Your group may not need to be large. It could also consist of your family, relatives, or officemates, who all intend to visit China along with you. This is aside from the fact that you could enjoy discounts on hotel or flight accommodations and reservations if you take them for your group.

On the corner of Golden Gate Ave. and Jones St. in the Tenderloin, San Francisco, right next to the Civic Center you can see a throng of low-income and homeless people lining up outside of St. Anthony’s Dining Room hall which opens up it’s doors everyday at 11:30 a.m. Volunteers dressed in St. Anthony Foundation shirts help keep the lines moving as hundreds of homeless and low income people shuffle their way towards the dining hall underneath the watchful eyes of a small statue of St. Francis of Assisi.

“There’s a lot of people who go hungry out here and it ain’t right.” says Jimmy Scott, a slightly brawny 44-year-old black man who has been living homeless in San Francisco for the past three years. “There are families out here with kids and everything and they have to walk around all night just to stay awake so they don’t get hurt or killed…Right here in the U.S. this is going on…it ain’t right.”

The dining hall, which has been open for the past 54 years, is owned by the St. Anthony Foundation which helps low income and homeless people and families in the Civic Center, Tenderloin, and SOMA areas with clothing, shelter, food, drug rehabilitation, and many other services. St. Anthony’s administrative offices are found at 121 Golden Gate Ave. with the majority of the foundation’s buildings on Golden Gate Ave. and Jones St.

“We are right in the heart of the homeless population of San Francisco,” says Barry Stenger, 55, who’s been working for the St. Anthony Foundation for one year, and is the Director of Development and Communications, “and people are pushed here because of the economic forces of San Francisco because it’s hard to be upper middle class in San Francisco.”

According to the San Francisco Chamber of Commerce, “San Francisco’s cost of living remains one of the highest in the country” with the average household income in San Francisco being around $76,400 and the average price of housing being $543,000. Average household income for the United States in 2002, according to the U.S. Census Bureau, was $42,409 and the average price of housing for the United States according to the National Association of Realtors was $185,200 in 2004.

“We served our 32 millionth meal on Tuesday,” said Stenger, “and we serve 2,500 meals a day. Some of our people who work here actually get served [food] here because they spend all their money towards rent and medical costs.”

The St. Anthony Foundation was started by Fr. Alfred Boeddeker in 1950 one year after Fr. Boeddeker became pastor of St. Boniface church on Golden Gate St. where he was baptized as a child. During his lifetime, according to the foundation’s website, he was referred to as the “Patron St. of the Tenderloin” and had Boeddeker park named after him because of his, and his foundation’s, achievements with helping out the homeless and low income community.

“[St. Anthony’s] is a good thing,” said Jimmy Scott, “they provide a good service and they feed people and they clothe them and provide furniture when you get housing and give you groceries when you have AIDS. It’s a good little organization.”

“Our dining room is open 365 days a year.” Said Stenger. “Our other facilities are open seven days a week. We have a residence for senior women and our [free medical] clinic is open five days a week and we also have a furniture and clothing store. We have 12 programs all together.”

Some of those programs are the Father Alfred Center which provides 61 men two programs for getting out of drug and alcohol abuse, the Employment Program/Learning Center which helps participants in educational and employment opportunities and provides each one with a personal staff advisor, and a Senior Outreach and Support Services center which states its mission is to “promote independence, self determination, and alleviate isolation” for seniors who are 60 and older.

A few homeless people who were interviewed complained that St. Anthony’s had some staff who were rude and that they were kicked out of the dining hall; other homeless within the area refuted those claims saying St. Anthony’s has nice staff and only kicks people out who cause trouble.

“It’s a good place and good people. Everybody is so kind and so respectful and everything is under control.” Said John Henderson, a tall and skinny 57-year-old homeless black man who has only been living in San Francisco for close to two months because he recently moved there from Phoenix, Arizona. “It’s pretty cool because they’re under control because yesterday I saw at Glide [Memorial Church which also has services for the poor and low income] and they were handing out food boxes and people were just rushing in and the woman in charge there was freaking out and so she just sat down. That would never happen at St. Anthony’s.”

“And they clean too!” Henderson said laughing with a grin on his face referring to the fact that there are no drugs allowed in the premises. “Not that Glide ain’t clean if you know what I mean.”

“We [also] have a whole division that deals with justice education and advocacy to change the system that brings people to our doorstep.” Said Stenger. “We hear a lot of appreciation from the people we serve. We get a lot of testimony from our clients who have become clean and sober. Sometimes we have to push them a little to get them out the door because they love the [foundation] so much because it has changed their lives.”
